🚨 Important: AI Service Limitations Companion AI is an artificial intelligence service for entertainment and companionship purposes. The AI is not a real person, therapist, counselor, or healthcare provider. Do not rely on the service for emergency situations, medical advice, legal advice, or professional counseling.

1. Acceptance of Terms

Welcome to Companion AI. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Companion AI ("Company," "we," "our," or "us") governing your access to and use of our AI companion application, website, and services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Eligibility and Account Requirements

2.1 Age Requirement

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that:

You are at least 18 years old or the age of majority in your jurisdiction
You have the legal capacity to enter into these Terms
You are not prohibited from using the Service under applicable laws

2.2 Account Registration

You must provide accurate, current, and complete information during registration
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms

Create multiple accounts or share accounts
Use another person's account without permission
Sell, transfer, or assign your account to others
Create an account using false information or automated means

3. Service Description

Companion AI provides an AI-powered virtual companion service that allows users to engage in conversations, roleplay scenarios, and interactive experiences. The Service includes:

Text-based conversations with AI companions
Voice calling capabilities with AI
Customizable AI personality and preferences
Roleplay scenarios, including adult and intimate content
Premium subscription features

4. Adult Content and Content Guidelines

4.1 Nature of Content

The Service includes adult content, including but not limited to sexually explicit conversations, intimate scenarios, and mature themes. All content is generated by artificial intelligence and does not involve real persons.

4.2 Prohibited Content

While the Service allows adult content between consenting adults (you and the AI), the following content is strictly prohibited:

Illegal Content: Any content involving minors, non-consent, or illegal activities
Violence: Extreme violence, gore, or content promoting harm to others
Harassment: Attempts to use the service to harass, threaten, or harm others
Hate Speech: Content promoting hatred, discrimination, or violence against groups
Illegal Activities: Content related to terrorism, trafficking, or other illegal activities
Exploitation: Any content that exploits or endangers minors

4.3 Content Monitoring

We reserve the right to monitor conversations for safety, security, and compliance purposes. Accounts found to be in violation of these content guidelines will be immediately terminated and may be reported to law enforcement.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

Violate any applicable laws, regulations, or third-party rights
Impersonate any person or entity or misrepresent your affiliation
Attempt to gain unauthorized access to the Service or related systems
Interfere with or disrupt the Service or servers
Reverse engineer, decompile, or disassemble any part of the Service
Use automated systems (bots, scrapers) to access the Service
Collect or harvest information about other users
Transmit viruses, malware, or harmful code
Use the Service for commercial purposes without authorization
Attempt to bypass any security features or access restrictions

6. Intellectual Property Rights

6.1 Our Rights

The Service, including all content, features, functionality, software, and technology, is owned by Companion AI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without express written permission.

6.2 Your Content

You retain ownership of any content you input into the Service. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store your content for the purposes of:

Providing and improving the Service
Training and improving our AI models (in anonymized form)
Ensuring safety and compliance
Enforcing these Terms

6.3 AI-Generated Content

Content generated by the AI during your interactions is created specifically for you. While you may save and keep this content for personal use, you may not commercially exploit or redistribute AI-generated content without authorization.

7. Subscription and Payment Terms

7.1 Free Trial and Free Features

We may offer free trials or limited free features. Free trials will automatically convert to paid subscriptions unless cancelled before the trial period ends.

7.2 Subscription Plans

Subscription fees are charged in advance on a recurring basis (monthly, annually)
Fees are non-refundable except as required by law or specified in these Terms
We reserve the right to change pricing with advance notice
Price changes will not affect your current subscription period

7.3 Payment Processing

Payments are processed through third-party payment processors (RevenueCat, Stripe). You agree to provide accurate payment information and authorize us to charge your payment method.

7.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings
Cancellation will take effect at the end of your current billing period
No refunds for partial subscription periods unless required by law
We reserve the right to refuse refunds for accounts terminated for violations

7.5 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can disable auto-renewal in your account settings.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

Confidentiality: We understand the intimate nature of your conversations. We implement strong security measures to protect your data and will never publicly disclose your conversations or personally identifiable information without your consent, except as required by law.

9. Disclaimers and Limitations

9.1 AI Limitations

IMPORTANT DISCLAIMERS:

The AI companion is not a real person and cannot form genuine relationships
The AI is not a substitute for human interaction, therapy, or professional advice
AI responses may be inaccurate, inappropriate, or offensive
The AI does not have emotions, consciousness, or genuine understanding
Conversations are generated by algorithms and do not reflect real experiences

9.2 No Professional Services

The Service is NOT:

Medical or mental health advice or treatment
Legal, financial, or professional advice
Crisis intervention or emergency services
A substitute for licensed therapy or counseling

9.3 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

9.4 Service Availability

We do not guarantee that the Service will be:

Available at all times or without interruption
Error-free or secure from unauthorized access
Free from viruses or harmful components
Accurate, reliable, or suitable for your purposes

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANION AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or goodwill
Emotional distress or psychological harm
Damages arising from your use or inability to use the Service
Damages arising from unauthorized access to your data
Damages arising from AI-generated content or advice

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Companion AI and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

Your violation of these Terms
Your violation of any applicable laws or regulations
Your violation of third-party rights
Your use or misuse of the Service
Your content or conduct on the Service

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Termination will result in the deletion of your account and data in accordance with our Privacy Policy.

12.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

You violate these Terms or our policies
You engage in illegal or harmful activities
You fail to pay subscription fees
We are required to do so by law
We discontinue the Service

12.3 Effect of Termination

Your right to access and use the Service will cease immediately
We may delete your account and data after termination
Provisions that should survive (disclaimers, limitations, indemnification) will remain in effect
No refunds will be provided for terminations due to violations

13. Modifications to Terms and Service

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Posting a notice in the app
Sending an email to your registered email address
Updating the "Last Updated" date at the top of these Terms

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

14.2 Arbitration Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Companion AI regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

15.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

15.6 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, or technical failures.

15.7 Export Controls

You agree to comply with all applicable export and import laws and regulations. You may not use the Service in any country subject to embargo or trade sanctions.

16. Apple and Google Terms

If you access the Service through the Apple App Store or Google Play Store, you acknowledge and agree to the following additional terms:

These Terms are between you and Companion AI, not Apple or Google
Apple and Google are not responsible for the Service or its content
Apple and Google have no warranty obligations regarding the Service
You must comply with all applicable third-party terms when using the Service
Apple and Google are third-party beneficiaries of these Terms with respect to your use of the mobile application

17. Acknowledgment and Consent

By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. You specifically acknowledge and consent to the following:

You are at least 18 years of age
You understand the Service includes adult content
You understand the AI is not a real person or professional service provider
You will not rely on the Service for emergencies or professional advice
You accept the risks and limitations described in these Terms
You have read and agree to our Privacy Policy
